This policy does not apply to information collected through any other website or to the practices of companies that Career Edge does not control. The Site also uses Google Analytics. Career Edge may access information about you from third-party sources and platforms (such as databases, online marketing firms, and ad targeting firms), including:

  • demographic data, such as age range, gender, and interests;
  • advertisement interaction and viewing data, such as ad click-through rates and information about how many times you viewed a particular ad; and
  • unique identifiers, including mobile device identification numbers, that can identify the physical location of such devices in accordance with applicable law.

Please note that Career Edge endeavors to collect only that information from third parties for which the information owner has opted in to receive marketing communications. The website may also combine the information that Career Edge collects with information obtain from third-party sources.

IV. PURPOSES FOR OUR COLLECTION AND USE OF PERSONAL INFORMATION

(1) General Uses

We may use Personal Information obtained through the Services in the following ways:

    To provide the Services;

    To provide, analyze, administer, develop, and improve the Site or our Services;

    To contact you in connection with the Site, our Services, and notifications, services, programs or offerings for which you may have registered;

If you register for our Services, Career Edge uses algorithms that enforce criteria to select the Services most suitable to you, which is the service that you (as the data subject) request from Career Edge. Use of our Services is voluntary and when you choose to participate and disclose your information to us, you also provide your explicit consent, which is freely given and can be withdrawn at any time by contacting us through the contact details further below.

V. WHO DO WE SHARE INFORMATION WITH?

We may disclose your personal information, combined personal, demographic, behavioral or indirect information to third parties, as set forth below.

(1) We may disclose such information to third parties if you consent to such disclosure. Our website contains links to third parties and other sources of information. If you follow links to another page, they may be provided with access to your information. If you indicate that you would like to receive information about the opportunities, products or services of third parties, we supply your contact information to select third parties such as employers, educational opportunities, placements and recruiting companies, data aggregators, marketers or others for the purpose of sending you e-mail or otherwise communicating with you. We use data we have about you (such as the interests and preferences you have expressed) to determine whether you might be interested in the opportunities, products or services of a particular third party. Any information that you provide to another site after leaving our website would be managed by their linked site and their Privacy Policy.

Email Communications: Career Edge may use the information that we collect to send you e-mail communications, information about your account or changes to the Site, and promotional messages about our own or our marketing partners' products and services. I also agree to receive relevant daily email from Career Edge and affiliated brands that may of interest to me. Your email address will be shared with our preferred marketing partner.

Mobile Communications: If you provide your mobile number, Career Edge may use your mobile number to send you promotions, notifications, or other services via short message service (“SMS”). Standard data fees and text messaging rates may apply based on your plan with your mobile phone carrier.

Telephone Communications: Career Edge may provide your telephone number to third parties in order to contact you regarding information or services that you have requested via the website or based on your responses to a survey that you have voluntarily responded to.

Advertising: Career Edge may display advertisements on the website, many of which are targeted based on information about you. For example, using information collected through cookies, web beacons, and other sources, we may use demographic data or information about your online activities or interests to display targeted advertising that may be relevant to your preferences. Through this process, advertisers reach website visitors who are most interested in their products, and you see advertising for products or services in which you may be interested.

Third-party advertisers and advertising platforms also may serve targeted ads on the website. Please remember that the information practices of third-party advertisers or platforms collecting data on our site are not covered by this privacy policy.

Profile Creation: Career Edge may use the information that is collected in order to create a user profile for you. The user profile enables Career Edge to more accurately match your demographics and interests with Career Edge services.

Request Fulfillment: Career Edge may use the information that is collected to fulfill your requests for products, services, and information.

Career Edge will never sell your phone number to a third party without your express consent. Career Edge may also sell or provide other information that is collected to third parties solely for legally permissible purposes.

You may choose not to be contacted by Career Edge by following the "unsubscribe" instructions in the specific email from which you wish to opt-out or emailing privacy@Career Edge.net, specifying the particular communications from which you wish to be removed.

To opt out of receiving marketing communications via SMS, respond to the text message that you have received with “Stop”, “Quit”, or “End”.

Please note, however, that even if you "opt out" as described above, Career Edge will not be able to remove your personal information from the databases of affiliates or third parties with which we have already shared your personal information. If you wish to stop receiving marketing communications from such affiliates or third parties, please contact them directly or utilize the opt-out mechanisms set forth in their respective privacy policies or marketing communications.

(2) We also share aggregated anonymous information about visitors to the Sites with clients, partners, other Site visitors, and other third parties so that they can understand the kinds of visitors to the Sites and how those visitors use the Sites. We may also aggregate on an anonymous basis data regarding demographics, location or health conditions.

(3) We disclose information if legally required to do so, if requested to do so by a governmental entity or if we believe in good faith – after considering your privacy interests and other factors – that such action is necessary to: (a) conform to legal requirements or comply with legal process; (b) protect our rights or property or our affiliated companies; (c) prevent a crime or protect national security; or (d) protect the personal safety of users or the public. Because Career Edge is a US company and information collected on our Sites is stored in whole or in part in the United States, your information may become subject to U.S. law.

(4) We may disclose and transfer such information to a third party who acquires all or a substantial portion of Career Edge's business, whether such acquisition is by way of merger, consolidation or purchase of all or a substantial portion of our assets.

Again, in each of these situations, the recipients of your data may potentially be located in any country in the world. If you are a resident in any EU member state, for example, you must be aware that the EU authorities do not generally consider that the regulations of non-EU countries ensure an adequate or equivalent level of protection as compared to the EU data protection regulations.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

VI. COMMUNICATION PREFERENCES

Once you register for our Services, if you have opted in to certain communications, you may be contacted at the phone number you provide including wireless number (if provided), by a representative of Career Edge (Short Code 78890) or its database administrator. You may opt out of these calls or texts at any time by sending an email to privacy@Career Edge.net. If you would like to stop receiving text messages, you may text STOP in reply to any messages that you receive.

With your consent (unless otherwise permitted by applicable law) we use the Personal Information you provide us to send you information on our products and Services and other information based on the interests that you have indicated to us. You have the right to opt out of getting those messages. If you do not wish to receive these messages, click the unsubscribe link in your email. Please note that these selections are not permanent; they may be changed in the event you register for other Services or communications and consent to receive marketing messages. California Consumer Privacy Act of 2018 ("CCPA"). The California Privacy Rights Act ("CPRA"). Browser "Do Not Track" Signals. Most browsers contain a "do-not-track" setting. (1) How We Collect and Use Personal Information

In accordance with various U.S. state laws such as listed above, this section describes the Personal Information we collected about residents in the last 12 months, the sources of that information, our business or commercial purposes for collecting the information, and the third parties with whom we shared that information.

We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Covered User or device ("personal information"). In particular, we have collected the following categories of personal information from Covered Users within the last twelve (12) months:

Personal information does not include:

  • Publicly available information from government records.
  • De-identified or aggregated Covered User information.
  • Information excluded from the scope of Applicable State Law, such as:
    • health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data; and
    • personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act of 1994.

We obtain the categories of personal information listed above (including (a) full name; (b) e-mail address; (c) mailing address; (c) daytime and/or cellular telephone numbers; and (d) date of birth) from the following categories of sources (with the specific categories of personal information indicated in parenthesis):

  • Directly from our Covered Users. For example, from online registration forms that our Covered Users submit to us in connection with our membership services, our promotions and the other products and/or services that we offer by and through the Site. (Category A, B and C)
  • Indirectly from our Covered Users. For example, through information we collect from our Covered Users in the course of providing our products and/or services to them. (Category A, B, C and D)
  • Directly and indirectly from activity on the Site. This includes the type of browser that you use (e.g., Safari, Chrome, Internet Explorer), your IP address, the type of operating system that you use (e.g., Windows or iOS) and the domain name of your Internet Service Provider. Retention of Personal Information and Sensitive Personal Information

We retain all categories of your personal information and sensitive personal information (including the information set forth in the "Personal Information that We Collect" section above) that we collect only as long as permitted by applicable law. We may also use certain criteria to determine whether and when to delete certain categories of collected personal and sensitive personal information including:

  • Date of collection.
  • Frequency of consumer interaction with us.
  • Last interaction the consumer had with us.
  • Whether the purpose of collection has been completed.

Use of Personal Information

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated or incompatible purposes without providing you with notice.

Sharing Personal Information

Subject to your right to opt-out of such sharing/sale, we may share, rent and/or sell your personal information only for the other business purposes set forth above.

When we disclose personal information to a third party service provider or other entity, we enter into a contractual relationship that describes the purpose for which such third party may use the personal information and requires that third party to both keep the personal information confidential and not use it for any purpose other than the performance of its services under the applicable contract.   • The categories of third parties with whom we have shared that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
    • sales, identifying the personal information categories that each category of recipient purchased; and
    • disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable Covered User request, we will delete (and direct our service providers, contractors and all third parties to whom we sold/shared your personal information, to delete) your personal information from our (their) records, unless an exception applies; provided, however, that in some cases, strictly for regulatory compliance purposes and to better evidence/honor opt-out/unsubscribe requests and other consumer rights requests (and for no other purposes), we may retain certain items of your personal information on a de-identified and aggregated basis in such a manner that the data no longer identifies you.

We may deny your deletion request if retaining the information is necessary for us or our service providers, contractors or third parties to whom we sold/shared your personal information, to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our obligations in connection with our contract with you.

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, and where you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with Covered User expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Right to Request Correction of Inaccurate Personal or Sensitive Personal Information

You have the right to request correction of inaccurate personal and/or sensitive personal information that we collect. Upon receiving a verifiable consumer request for correction, we will make commercially reasonable efforts to correct information identified as inaccurate. Where we correct inaccurate personal and/or sensitive personal information, we shall instruct all service providers and/or contractors that maintain such personal and/or sensitive personal information in the course of providing services to us to make the necessary corrections in their respective systems.

Exercising Access, Data Portability, Right to Correct and Deletion Rights

To exercise your access, data portability, right to correct and/or deletion rights described above, please submit a verifiable Covered User request to us by either:

The verifiable Covered User request must:

  • Provide sufficient information that allows us to reasonably verify that you are: (1) the person about whom we collected personal information; or (2) an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you. Making a verifiable Covered User request does not require you to create an account with us. We will only use personal information provided in a verifiable Covered User request to verify the requestor's identity or authority to make the request.

Response Timing and Format

We endeavor to respond to all verifiable Covered User requests to exercise Access, Data Portability, Right to Correct and Deletion Rights within forty-five (45) days of the receipt thereof. If we require more time (up to an additional (45) days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the twelve (12) month period preceding the receipt of your verifiable request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable Covered User request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Opt-Out Preference Signal Processing

When we receive a an Opt-Out Preference Signal from your browser, we treat it as a "Do Not Sell or Share My Information" request. You may still be shown offers on the Site and links to third-party websites that have their own separate privacy policy and means for honoring Opt-Out Preference Signal requests.

Authorized Agents

Covered Users may permit an authorized agent to exercise any rights granted under Applicable State Laws as set forth above. In order to utilize an authorized agent, you must provide the authorized agent with written permission from you to act on your behalf for these purposes. When you use an authorized agent to submit a request to delete, request to correct or a request to know, we may require the authorized agent to provide proof that you gave the agent signed permission to submit the subject request. We may also require you to do either of the following: (a) verify your own identity directly with us; or (b) directly confirm with us that you provided the authorized agent permission to submit the request.

For California residents, only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable Covered User request related to your personal information.

Non-Discrimination

We will not discriminate against you for exercising any of your rights under Applicable State Laws. Unless permitted by Applicable State Laws, we will not:

  • Deny you goods or services;
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
  • Retaliate against any employee, job applicant or independent contractor;
  • Provide you a different level or quality of goods or services; and/or
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

IX. INDIVIDUAL RIGHTS - USERS IN THE EEA OR SWITZERLAND

The Career Edge website is operated in the United States. These recourse mechanisms are available at no cost to you. Damages may be awarded in accordance with applicable law. Please note that if your complaint is not resolved through these channels, under limited circumstances, a binding arbitration option may be available before a Privacy Shield Panel. Pursuant to the Privacy Shield, Career Edge remains potentially liable for the transfer of Personal Information to third parties acting as our agents unless we can prove we were not a party to the events giving rise to the damages.

In cases of onward transfer to third parties of Personal Information of individuals in the EEA or Switzerland received pursuant to the EU-U.S. and Switzerland-U.S. Privacy Shield, Career Edge is potentially liable.

XII. DATA RETENTION

We keep Personal Information for as long as it is needed to fulfill the purposes for which it was collected, to provide our Services, to deal with possible legal claims, to comply with our business interests and/or to abide by all applicable laws. Thereafter, we either delete Personal Information about you or de-identify it. Please note that even if you request the deletion of Personal Information about you, we may be required (by law or otherwise) to retain the Personal Information and not delete it. However, once those requirements are removed, we will delete Personal Information about you in accordance with your request.

Therefore, while we strive to use commercially acceptable means to protect Personal Information, we cannot guarantee its absolute security.

XIV. CHILDREN

Career Edge does not knowingly collect any information from anyone who we know to be under the age of 13. If you are under the age of 18, you should use this website only with the involvement of a parent or guardian and should not submit any personal information to us. If Career Edge discovers that a person under the age of 13 has provided Career Edge with any personal information, Career Edge will use commercially reasonable efforts to delete such person's personal information from all Career Edge systems.

XV. CHANGES TO THE PRIVACY POLICY

This Privacy Policy may change from time to time, effective from the date mentioned in the updated version of the Privacy Policy. Please check the Platforms periodically to review such changes in the Privacy Policy. We may email periodic reminders of our agreements and policies in the event of a material change.

XVI. DISPUTES

All disputes, controversies and claims from or relating to this privacy policy, including any subsequent updates, shall be submitted to arbitration before the American Arbitration Association (“AAA”) in accordance with the AAA Commercial Arbitration Rules. The place of arbitration shall be Austin, Texas and the proceedings shall be English. The arbitrator may award any form of individual or equitable and injunctive relief. Any award will be final and conclusive to the parties and may be entered in any court of competent jurisdiction. The parties may also plead to any court of competent jurisdiction for a temporary restraining order, preliminary injunction, or other interim relief, without breach of this paragraph and without reducing the scope of the powers of the arbitrator. You agree to the entry of injunctive relief to stop any lawsuit or to remove you as a participant in such a suit. By agreeing to this provision, you waive your right to bring, join, or participate in a class action lawsuit related to this privacy policy; however, you do not waive your rights or remedies to pursue an individual claim in binding arbitration. The preceding provision is an independent covenant, which you may opt out of by providing written notice of your decision within thirty (30) days of the date that you first use the Career Edge website.
