Any dispute, controversy or claim arising under, out of or relating to this Policy and any subsequent amendments including, without limitation, formation, validity, binding effect, interpretation, performance, breach or termination, as well as non-contractual claims, shall be submitted to arbitration before the American Arbitration Association (“AAA”) in accordance with the AAA Commercial Arbitration Rules. The place of arbitration shall be Austin, Texas. The language to be used in the arbitral proceedings shall be English. The parties may apply to any court of competent jurisdiction for a temporary restraining order, preliminary injunction, or other interim or conservatory relief as necessary, without breach of this paragraph and without abridgment of the powers of the arbitrator. The arbitrator may award any form of individual or equitable relief, including injunctive relief. Any award will be final and conclusive to the parties and may be entered in any court of competent jurisdiction. You agree to the entry of injunctive relief to stop any lawsuit or to remove you as a participant in such a suit. Your agreement to this provision does not constitute a waiver of any of your rights and remedies to pursue an individual claim in binding arbitration, but not as a class action. This provision preventing you from bringing, joining or participating in class action lawsuits is an independent covenant. You may opt-out of this provision by providing written notice of your decision within thirty (30) days of the date that you first use the Sites.

The Sites are intended for users who are physically located in the United States. CareerEdge requires each user to provide us with personal information (collectively "Personally Identifiable Information") to access and use CareerEdge products and services. Personally Identifiable Information is captured only when a user accesses the Sites, or speaks on the phone with a CareerEdge employee or authorized third party service provider, and willingly discloses that information. This disclosure may occur when a user registers with the Sites, engages in transactions, contacts customer service, or participates in contests, promotions, surveys, forums, content submissions, requests for suggestions, or other aspects of services offered by CareerEdge.

CareerEdge may also periodically obtain both Personally Identifiable Information and non-personal information about you from third parties, such as CareerEdge business partners and advertisers to whom you have willingly provided your information, and add it to the CareerEdge database. CareerEdge employs a software technology called clear gifs (a.k.a. web beacons), that help CareerEdge track referrals from our partners and affiliates and better manage content on the Sites. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on web pages and are about the size of the period at the end of this sentence. We do not tie the information gathered by clear gifs to users’ Personally Identifiable Information.
